Privacy Policy

When you use our services, you’re trusting us with your information. We understand this is a big responsibility and work hard to protect your information and put you in control. This Privacy Policy is meant to help you understand what information we collect, why we collect it, and how you can update, manage, export, and delete your information. We have tried to be as straightforward as possible in our explanations, but if terminologies such as cookies, IP addresses, pixel tags, and browsers are unfamiliar to you, please familiarise yourself with these key terms (available at the end of this Privacy Policy). Your privacy is important to us, so whether you are a new or long-time user of our products and services, take the time to familiarise yourself with our practices, and if you have any questions, feel free to contact us.

1. Information We Collect

We want to explain to you the types of data we collect when you use our services. We collect information to provide better service to all our users — from basic things like the language you speak to more complex matters like which ads you might find interesting or which product you might like. We gather device-related information (such as hardware model, operating system version, unique device identifiers, screen resolution, country, language, etc.).

2. Things You Create or Provide to Us

When you create an account, you provide us with personal information that includes your name and password. You can also choose to add a phone number or payment information to your account. Even if you aren’t signed in to an account, you might choose to provide us with information — like an email address to communicate with us or receive updates about our services. We also collect the content you create, upload, or receive from others when using our services. This includes things like photos and videos you save, messages you create, and comments you make on Watch TV+.

3. Information We Collect as You Use Our Services

We collect information about the apps, browsers, and devices you use to access our services, which helps us provide features like automatic product updates and dimming your screen if your battery runs low. The information we collect includes unique identifiers, browser type, device type, operating system, and application version number. We also collect information about the interaction of your apps, browsers, and devices with our services, including IP address, crash reports, system activity, and the date, time, and referrer URL of your request.

We may collect and store information (including personal data) locally on your device using mechanisms such as browser web storage (including HTML5), application data caches, cookies, or pixel tags.

Browser web storage allows websites to store data in a browser on your device. When used in “local storage” mode, it enables data storage for all sessions (so that data, for example, can be accessed even after closing and reopening the browser). HTML5 is one of the technologies that enable web storage.

A cookie is a small file containing a string of characters that is sent to your computer when you visit a website. When you revisit that website, the cookie allows it to recognise your browser. Cookies can store user preferences and other data. You can set your browser to refuse all cookies or to indicate when a cookie is being sent. However, some features or services of websites may not function properly without cookies. Other technologies are used for similar purposes as cookies on platforms where cookies are not available or applicable.

Our websites, internet services, interactive applications, email messages, and advertisements may use cookies and other technologies. These technologies help us better understand user behaviour, show which parts of our websites users have visited, and enable us to measure the effectiveness of advertisements and internet searches. Data collected through cookies and other technologies are considered non-personal information. However, if under local regulations IP addresses (Internet Protocol) or similar identifiers are considered personal data, we also treat them as personal data. Similarly, if non-personal data is combined with personal data, we treat the combined data as personal data for the purposes of these privacy rules. Like most internet services, we automatically collect some data and store it in log files. This data includes IP addresses (Internet Protocol), browser type and language, Internet service provider (ISP), referral and exit pages, and applications, operating system, timestamp, and clickstream data.

We use this data to understand and analyse trends, administer the website, learn more about user behaviour on the site, improve our products and services, and collect demographic data about our user base as a whole. We may use this data for marketing and advertising purposes.

In some of our email messages, we use “click-through URLs” linked to content on our website. When users click on one of these URLs, they may pass through a separate web server before arriving at the destination page on our website. We track this click-through data to help determine interest in specific topics and measure the effectiveness of our communication with users. If you do not wish to be tracked in this way, do not click on text or graphic links in email messages.

A pixel tag is a type of technology placed on a website or in the body of an email to track activity on websites, such as the time when emails are opened or accessed, and is often used in combination with cookies.

We use Microsoft Clarity and/or Google Analytics to better understand the needs of our users and optimise our service and user experience. Microsoft Clarity and Google Analytics are technological services that help us better understand the experience of our users (e.g., how much time they spend on which pages, which links they follow, what they like and dislike, etc.). This allows us to build and maintain our services with user feedback. Microsoft Clarity and Google Analytics use cookies and other technologies to collect data about the behaviour of our users and their devices. This includes the device’s IP address (processed during your session and stored in an unidentified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and preferred language used for displaying our website. Microsoft Clarity, and Google Analytics store this data on our behalf in a pseudonymized user profile. Microsoft Clarity and Google Analytics are contractually prohibited from selling any data collected on our behalf. We collect this data when you access or use our services.

4. The Information You Provide Us

For example, when creating a user account or when ordering products and/or services. When you do so, we will request personal information such as your full name, address, email address, phone number, or credit card number, which we will store in your account (if you choose to do so). We may use this information to contact you, for instance, to send notifications about your account, security updates, product information, order processing, and the functionality of our services. Additionally, we ask for information on a form where the user provides contact information such as name, email address, phone number, and sometimes an address. Contact information is used to contact the user to verify orders/data or in case of any issues in processing an order. When you contact us via email, we reserve the right to review and archive all email messages for security and other purposes. All email messages are stored for a maximum of 10 years, however, at our discretion, some or all email messages may be retained permanently.

5. Your Activity

We collect data about your activities on our services to, for example, recommend a movie on the Watch TV+ service that you might like based on them. The activity data we collect may include:

  • Terms you search for
  • Videos you watch
  • Purchase activity
  • People with whom you communicate or share content
  • Content you mark as favourite

6. Why Do We Collect Data

We use the data to better develop and protect our services. The collected data from all our services is used for the purposes listed below.

We use the data collected across all our services to provide, maintain, protect, and improve those services, as well as to develop new services and protect ourselves and our users. We also use your data to ensure the proper functioning of our services, such as monitoring downtime or resolving issues you report to us.

A. Measure performance

We use data for analytical and measurement purposes to understand various ways our services are used. For example, we analyse data about your visits to our websites, among other things, to optimise product design. To this end, we use various tools, including Google Analytics, and Microsoft Clarity. Data collected from other technologies Information collected from cookies and other technologies, such as pixel tags, is used to improve the user experience and overall quality of our services.

B. Consent

We will ask for your consent before using information for purposes not outlined in this Privacy Policy.

C. Communicate with you

We use information we collect, like your email address, to interact with you directly. For example, we may send you a notification if we detect suspicious activity, like an attempt to sign in to your account from an unusual location. Or we may let you know about upcoming changes or improvements to our services. And if you contact us, we’ll keep a record of your request in order to help solve any issues you might be facing.

D. Protect us, our users, and the public

We use information to help improve the safety and reliability of our services. This includes detecting, preventing, and responding to fraud, abuse, security risks, and technical issues that could harm us, our users, or the public.

We use different technologies to process your information for these purposes. We use automated systems that analyse your content to provide you with things like customised search results, personalised ads, or other features tailored to how you use our services. And we analyse your content to help us detect abuse such as spam, malware, and illegal content. We also use algorithms to recognise patterns in data.

E. Child Sexual Abuse Material (CSAM)

On all our services, we use a tool for scanning materials for child sexual abuse (CSAM), which allows us to proactively identify and take action. We have selected specific hash lists from leading child safety organisations such as the National Center for Missing and Exploited Children (NCMEC). If a match is identified, CloudFlare (our CSAM tool provider) will notify NCMEC, the service owner, and the hosting service provider so that we can take immediate action to address this material. Additionally, we will automatically report the case to law enforcement authorities such as the police or the state prosecutor’s office.

WE AND OUR PARENT COMPANY, SUBSIDIARIES, OFFICERS, DIRECTORS, AGENTS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY MATERIAL YOU TRANSMIT TO OUR SERVERS OR SERVICES. BY ACCEPTING LIABILITY, YOU RELEASE US FROM ALL LIABILITIES RELATED TO YOUR USE OF OUR PRODUCTS AND SERVICES AND AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS US, OUR PARENT COMPANY, SUBSIDIARIES, OFFICERS, DIRECTORS, AGENTS, AND EMPLOYEES FOR ANY CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS, OR DEBTS (INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES) ARISING FROM: (I) YOUR USE OF OUR PRODUCTS AND/OR SERVICES; (II) YOUR VIOLATION OF ANY TERM OF THESE TERMS; (III) ANY VIOLATION OF ANY THIRD PARTY’S RIGHTS, INCLUDING WITHOUT LIMITATION COPYRIGHT, OWNERSHIP, OR PRIVACY RIGHTS; (IV) ANY CLAIMS OF ANY THIRD PARTY RELATED TO YOUR USE OF OUR PRODUCTS AND/OR SERVICES, CLAIMS ARISING FROM USE, OR (V) ANY ALLEGATIONS THAT YOUR USE VIOLATES ANY LAW, RULE, OR REGULATION.

7. Sharing Your Data

A. Learn how you can share your data

The collected data from all our services can be shared in the following ways. Additionally, for legal reasons, we may share your data.

B. The data you share

Our services allow you to share information with other individuals. Remember, when you publicly share information, search engines may index it. Our services provide you with various sharing options such as wish lists.

C. The data we share

At no point will we sell your data to third parties. We do not share personal data with companies, organisations, and individuals outside of our company, except in the following circumstances:

With your consent

We will share personal information with companies, organizations, or individuals outside of our company if we have your consent. We require your permission for the possibility of sharing sensitive personal data.

For legal reasons

We will share personal information outside of our company if we have a good-faith belief that disclosure of the information is reasonably necessary to:

  • Respond to any applicable law, regulation, legal process, or enforceable governmental request
  • Enforce applicable Terms of Service, including investigation of potential violations
  • Detect, prevent, or otherwise address fraud, security, or technical issues
  • Protect against harm to the rights, property or safety of us, our users, or the public

We may share non-personally identifiable information publicly and with our partners — like publishers, advertisers, developers, or rights holders. For example, we share information publicly to show trends about the general use of our services. We also allow specific partners to collect information from your browser or device for advertising and measurement purposes using their own cookies or similar technologies.

If we are involved in a merger, acquisition, or sale of assets, we’ll continue to ensure the confidentiality of your personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy.

8. Your Privacy Controls

You have the option to choose regarding the data we collect and how we use it. This section describes the main controls for privacy management on all our services.

Each time you use our services, we strive to provide you with access to your personal data. If this data is incorrect, we aim to provide you with ways to quickly update or delete it – unless we are required to retain it for legitimate business or legal reasons. When updating personal data, we may ask you to confirm your identity in order to respond to your request.

We may reject unjustifiably repetitive requests, requests requiring disproportionate technical effort (for example, the development of a new system or fundamental change to an existing process), requests that jeopardise the privacy of others, or are highly impractical (for example, requests regarding information contained in backups).

Where we can provide access to information and its correction, we will do so free of charge, except where it would require inappropriate effort. We strive to maintain our services in a manner that protects information from accidental or malicious destruction. Therefore, after you delete information from our services, we may not immediately delete residual copies from our active servers, and we may not remove information from our backup systems.

If you wish to withdraw your consent for contacting, you can do so by clicking on the prominently displayed unsubscribe link found in every email notification you receive or by sending an opt-out request to our email address ([email protected]). When withdrawing consent for contacting or sending an opt-out request to our email address, you must provide contact information and the exact email address you are unsubscribing. If you have more than one email address, be sure to specify which one you are unsubscribing or do so for all addresses.

9. Exporting and Deleting Your Data

At your request, you can export a copy of the content from your user account to back it up or use it on another service. You can also request the removal of content from specific services based on applicable laws. If you need assistance with exporting, removing, or deleting data, please contact us.

10. Protection of Your Data

Security is built into all our services to protect your data. All our products and services are developed with robust security features that continuously safeguard your data. The knowledge we gain from maintaining our services helps us detect and automatically block security threats before they reach you. And if we detect anything suspicious that we believe requires your attention, we will notify you and provide detailed instructions on how to better protect yourself. We work hard to protect you and us from unauthorised access, alteration, disclosure, or destruction of the data we hold.

For example:

  • We use data encryption during transmission to protect their privacy
  • All of our services are encrypted with SSL
  • We thoroughly verify your identity. For example, if you ask us to change your account password, update your account information, or provide support that requires access to your account
  • We offer various security features, such as Two-Factor Authentication, for better protection of your account
  • We review our data collection, storage, and processing practices, including physical security measures, to protect our systems from unauthorised access
  • Access to personal data is limited to our employees, contractors, and agents who need that data for processing purposes. All those with such access are required to strictly adhere to confidentiality obligations, and disciplinary measures or termination may be applied if those obligations are not met

11. Minors

We advise all parents and guardians to educate their children on how to safely and responsibly use their personal information on the Internet. Minors should not provide any personal information on our services without parental or guardian consent. We will never knowingly collect data from minors and use it in any way or disclose it to any third party without permission, unless required by law. We require that minors do not make purchases or engage in other legal transactions related to our products and services without parental or legal guardian consent, and we do not wish to receive personal information directly from minors. However, sometimes it may not be possible to determine the age of individuals participating in such transactions or providing personal information. If a minor (according to applicable laws) does provide personal information without parental or guardian consent, we ask parents or guardians to inform us so that we can remove that information.

12. Compliance and Cooperation With Legislators

We regularly review these privacy policies and ensure that we process your data in ways that are compliant with them.

13. Processing Data on Servers in Other Countries

Our servers are located worldwide, and your data may be processed on servers outside of the country where you live. Data protection laws vary from country to country, with some providing more protection than others. Regardless of where your data is processed, we apply the same security measures described in these policies. When we receive an official written complaint, we will contact the person who submitted the complaint. We cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints related to data transfers that we cannot address directly with you.

14. European requirements

If European Union (EU) or United Kingdom (UK) data protection law applies to the processing of your information, we provide the controls described in this policy so you can exercise your rights to request access to, update, remove, and restrict the processing of your information. You also have the right to object to the processing of your information or export your information to another service.

If you have additional questions or requests related to your rights, you can contact us and our data protection office. And you can contact your local data protection authority if you have concerns regarding your rights under local law.

15. Legal Bases of Processing

We process your information for the purposes described in this policy, based on the following legal grounds:

A. Consent

We ask for your consent to process your data for certain purposes and you have the right to withdraw your consent at any time. For example, we ask for your consent to provide you with customised services such as advertisements.

B. When pursuing legitimate interests

  • Providing, maintaining and improving our services to meet the needs of our users
  • Development of new useful products and features for our users
  • Understanding how people use our services to enable and improve the performance of our services
  • Customisation of services to provide you with a better user experience
  • Marketing to inform users about our services
  • Detecting, preventing or otherwise resolving fraud, abuse, security or technical difficulties with our services
  • To protect against infringement of the rights, property or safety of us, our users or the public as required or permitted by law
  • Conducting research that improves our services for users and the public
  • Fulfilling obligations to its partners such as developers and rights owners
  • Enforcement of legal requests, including investigation of possible violations of applicable terms of service

C. When providing services

We process your data in order to provide you with the service you requested under the contract.

D. When fulfilling our legal obligations

We also process your data when we are legally obliged to do so, for example by legal procedure or a valid request from the authorities.

E. Transparency and choice

Different people are concerned about different aspects of privacy. Our goal is to clearly explain what information we collect so that you can make informed decisions about how to use it. View and update your personal information within your user account. You can also set your browser to block all cookies, including cookies associated with our services or to be notified when we set a cookie. However, it is important to note that many of our services will not function properly if you disable cookies. For example, we won’t be able to remember your language settings.

16. Application of Rules

Our privacy policy applies to all services offered by us and our affiliates, as well as services offered on other websites (for example, within our other websites), but excludes services that have separate privacy policies not covered by this privacy policy. Our Privacy Policy does not apply to services offered by other companies or individuals. Our Privacy Policy does not cover the practices of other companies and organisations that advertise our products and services, which may use cookies, pixel tags, and other technologies to serve and provide relevant advertisements.

17. Changes to This Policy

We change this Privacy Policy from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent. We always indicate the date the last changes were published. If changes are significant, we’ll provide a more prominent notice (including, for certain services, email notification of Privacy Policy changes).

18. Key Terms

Affiliates

An affiliate is an entity that belongs to our group of companies.

Algorithm

A process or set of rules followed by a computer in performing problem-solving operations.

Application data cache

An application data cache is a data repository on a device. It can, for example, enable a web application to run without an internet connection and improve the performance of the application by enabling faster loading of content.

Browser web storage

Browser web storage enables websites to store data in a browser on a device. When used in “local storage” mode, it enables data to be stored across sessions. This makes data retrievable even after a browser has been closed and reopened. One technology that facilitates web storage is HTML 5.

Cookies

A cookie is a small file containing a string of characters that is sent to your computer when you visit a website. When you visit the site again, the cookie allows that site to recognise your browser. Cookies may store user preferences and other information. You can configure your browser to refuse all cookies or to indicate when a cookie is being sent. However, some website features or services may not function properly without cookies.

Device

A device is a computer that can be used to access our services. For example, desktop computers, tablets, smart speakers, and smartphones are all considered devices.

Account

You may access some of our services by signing up for an account and providing us with some personal information (typically your name, email address, and a password). This account information is used to authenticate you when you access our services and protect your account from unauthorised access by others. You can edit or delete your account at any time through your account settings.

Referrer URL

A Referrer URL (Uniform Resource Locator) is information transmitted to a destination webpage by a web browser, typically when you click a link to that page. The Referrer URL contains the URL of the last webpage the browser visited.

IP address

Every device connected to the Internet is assigned a number known as an Internet protocol (IP) address. These numbers are usually assigned in geographic blocks. An IP address can often be used to identify the location from which a device is connecting to the Internet.

Sensitive personal information

This is a particular category of personal information relating to topics such as confidential medical facts, racial or ethnic origins, political or religious beliefs, or sexuality.

Server logs

Like most websites, our servers automatically record the page requests made when you visit our sites. These “server logs” typically include your web request, Internet Protocol address, browser type, browser language, the date and time of your request, and one or more cookies that may uniquely identify your browser.

Unique identifiers

A unique identifier is a string of characters that can be used to uniquely identify a browser, app, or device. Different identifiers vary in how permanent they are, whether they can be reset by users, and how they can be accessed. Unique identifiers can be used for various purposes, including security and fraud detection, syncing services such as your email inbox, remembering your preferences, and providing personalised advertising. For example, unique identifiers stored in cookies help sites display content in your browser in your preferred language. You can configure your browser to refuse all cookies or to indicate when a cookie is being sent.
